Delaware's online sports betting is a state lottery product, not a commercial licensing market: the Delaware Lottery runs a sports lottery under 29 Del. Pari-mutuel horse racing is confined by statute to the race-meeting enclosure, and prediction markets are unlicensed.

How the Market Works

Delaware has legal sports betting, and it is a lottery product rather than a licensed commercial market. There is no Delaware sportsbook licence in the sense used in most states: the Delaware Lottery runs a "sports lottery" under Title 29 of the Delaware Code, the state's three racetrack casinos act as the agents that host it, and the online platforms sit on a single technology provider. The minimum age is 21. Horse racing is recorded as prohibited for online purposes, because Delaware law confines pari-mutuel wagering to the enclosure of a licensed race meeting. Event-contract platforms sit in a grey area here, with nothing of the kind licensed by the state.

Delaware Online Sportsbooks

The authority is 29 Del. C. § 4825, which opens:

"The Director shall, pursuant to the authority granted under § 4805(a)(1) and (b)(4) of this title, commence a sports lottery as soon as practicable. The Director shall, by rules and regulations, provide for the features and attributes of a sports lottery."

That single sentence is the whole legal basis, and it explains why Delaware behaves differently from its neighbours. The statute instructs the Director to administer the sports lottery "in a manner which will produce the greatest income for the State while minimizing or eliminating the risk of financial loss to the State" — a lottery mandate, not a competitive licensing mandate. Section 4825 then allows the Director to run the sports lottery at facilities operated by licensed video lottery agents and at other licensed sports lottery agents, and provides that a video lottery agent's existing licence "shall automatically allow those agents to operate facilities at which the sports lottery can be conducted."

A "video lottery agent" is defined in § 4802 as a person licensed to conduct table games, video lottery, sports lottery and Internet lottery games who holds a horse racing meet licence or a harness racing meet licence. In other words, the agents are the state's racetrack casinos, and the sports lottery was bolted onto an existing racing-and-gaming licence rather than created alongside a new one. Delaware Sports Betting Sites

Three casinos hold the relevant agent licences, and the Delaware Lottery names them: Delaware Park Casino, Bally's Dover, and Harrington Raceway & Casino. On the internet side, the Lottery's own page states that internet games are available through those Delaware casinos and that players can play "Online Sports from the NEW platforms powered by BetRivers," adding that "you must 21 years old and in the state of Delaware to play." The Lottery names the three casinos whose online platforms carry it in the same notice. So what looks like three casino-branded online products runs on one platform provider.

Retail is wider than the casinos. In a July 2026 announcement the Lottery said that it had "installed the kiosks at all 89 Sports Lottery Retailers, as well as in Delaware's three casinos" and that the "new kiosks, with odds and betting menu provided by Caesars Sportsbook, offer an alternative to clerk-assisted sports betting options at retailers." The parlay card product sold through Sports Pick retailers is a separate, older part of the same sports lottery.

Verification therefore works differently here. Rather than checking a brand against a licensee register, check that the site or kiosk you are using is reached through the Delaware Lottery's internet gaming page or one of the three named casinos, and that the retail outlet is a listed Sports Lottery Retailer on the Lottery's locations page. Anything offering Delaware sports wagers outside the sports lottery is outside the statute.

Delaware Sports Betting Laws

The age limit is stated twice. Section 4825 provides that a "person under the age of 21 may not purchase a sports lottery ticket, or wager on a sports lottery machine, or in any way participate in the sports lottery," and the chapter's offence provisions add that it "is unlawful for an individual who is under 21 years old to wager on the video lottery, sports lottery, table games, internet table games, or internet video lottery," with a parallel duty on agents and their employees not to allow it.

The chapter also keeps machines and equipment under state control: all sports lottery machines "shall be owned or leased by the State" and obtained from licensed manufacturers, and must be connected to the Lottery's central computer system. Licensing of agents runs through the Director, who considers "the experience, character and general fitness of the applicant" and must give preference to proposals likely to foster economic growth and employment. A licence is "a privilege personal to the sports lottery agent and is not a legal right," and it cannot be transferred, assigned or pledged.

Horse Racing Betting in Delaware

Horse racing is recorded as prohibited, and that refers to the online position rather than to racing itself. Delaware has live racing and the statutory framework for pari-mutuel wagering, but Title 3 confines where that wagering may happen:

"Within the enclosure of any horse race meeting licensed and conducted under this chapter, but not elsewhere, the wagering or betting on horse races or harness horse racing or both by the use of pari-mutuel machines or totalizators and by manual computation without the use of pari-mutuel machines or totalizators is authorized and permitted."

"But not elsewhere" is the operative phrase. The authorisation is geographic, tied to the enclosure of the race meeting, and the separate "Internet lottery" definition in Title 29 reaches Internet ticket games, the Internet video lottery and Internet table games — it does not extend to pari-mutuel racing wagers. On the state's own published law, then, there is no Delaware authorisation for taking a resident's horse-racing account wager remotely. The relevant chapter is Title 3, Chapter 101.

Prediction Markets in Delaware

Prediction markets are recorded as a grey market. That means Delaware has neither licensed an event-contract platform nor brought one inside the sports lottery, and nothing on this page should be taken as suggesting the state has authorised one. Because the only lawful route to a sports wager in Delaware is the sports lottery operated by the Director through licensed agents, an exchange selling contracts on sporting outcomes holds no Delaware authorisation.

Responsible Gambling in Delaware

The Delaware Lottery publishes the state helpline prominently: the Delaware Council on Gambling Problems Helpline on 1-888-850-8888, described as free, professional advice and assistance available 24 hours a day, seven days a week, alongside deproblemgambling.org. The Lottery also runs a self-exclusion programme covering internet gaming, video lottery and table games, and notes that a portion of lottery proceeds is channelled through the Department of Health and Social Services to fund problem gambling programmes, with more than $1.8 million contributed in one recent fiscal year. Delaware runs its sports lottery itself through licensed video lottery agents under 29 Del. C. §4825, so there is no licensing route for another operator and no register to appear on. No operator is listed for Delaware because none lawfully may be.
