Montana's sports betting is a state lottery product and the geofence sits in the statute: MCA 23-7-103(11) defines a sports wagering licence as authorising mobile wagering only where it is "initiated and received or otherwise made exclusively within the physical confines using location-based services of the single approved sports wagering facility", so a bet must be placed inside a licensed Sports Bet Montana retailer. The minimum age is 18 across every product. Horse racing is the exception: MCA 23-4-301(7) licenses advance deposit wagering hub operators, and the Board of Horse Racing publishes the list of licensed hubs.

How the Market Works

Montana has lawful sports betting, it is run by the state lottery under the name Sports Bet Montana, and the geofence that keeps it off a phone at home is written into the statute itself. A wager must be struck inside a licensed Sports Bet Montana retailer — a bar, tavern or gaming establishment that holds the licence — either at the retailer's terminal or on the app while location services confirm that the bettor is standing on those premises. Two further things make Montana unusual: the minimum age is 18 for every betting product, and the state licenses genuine remote wagering on horse racing through advance deposit hub operators that the Board of Horse Racing publishes by name.

Where a Sports Bet May Lawfully Be Placed in Montana

Only at an approved sports wagering facility. The controlling text is a definition in the Montana Code Annotated, MCA 23-7-103(11):

"'Sports wagering license' means a license issued by the state lottery that authorizes the operation of sports wagering through sports wagering equipment, including sports wagering conducted through mobile application or other digital platforms that is initiated and received or otherwise made exclusively within the physical confines using location-based services of the single approved sports wagering facility."

Subsection (10) defines that facility as an approved lottery location licensed as a gambling operator. The definition of the activity in subsection (7) is deliberately broad — sports wagering means accepting wagers "by any system or method of wagering, including but not limited to in-person or over the internet through websites and on mobile devices" — and the term "does not include… any wagers made outside the state". MCA 23-7-104 makes the activity lawful "as it pertains to the state lottery" when conducted under that chapter. The Montana Lottery describes the product the same way on its sales agents page, telling customers they can place bets "directly at their locations using the machine or through our SBM mobile app".

Why There Is No Statewide Montana Betting App

Because no licence could authorise one. The restriction is not an administrative policy a regulator could relax; it is part of the statutory definition of what a sports wagering licence is, so a wager initiated outside the approved facility falls outside the licence altogether. There is no commercial sportsbook to hold a licence, no statewide account to open, and nothing for a remote operator to apply for. The constraint is statutory, not constitutional — sports wagering was created by ordinary legislation in 2019 (Ch. 284, L. 2019), and ordinary legislation could change its geographic reach.

Montana Sports Betting Laws

The lottery sells two licence types, and MCA 23-7-301 leaves it to the commission to "determine the places at which state lottery games and sports wagering tickets, chances, wagers, or bets may be sold". Two older sports-wagering products survive and are equally retail-bound: MCA 23-5-502 allows sports pools and sports tab games "only by a licensed gambling operator on premises appropriately licensed to sell alcoholic beverages", and 23-5-501(1)(b) excludes "multiple competitor sports pools utilizing any form of internet gambling".

On age, Montana is the outlier. MCA 23-7-302(2) provides that "tickets, chances, wagers, or bets may not be sold to or purchased by persons under 18 years of age". The racing chapter defines a minor as "a person under 18 years of age", and MCA 23-5-158 bars allowing anyone under 18 to participate in a gambling activity. So 18 is the floor across sports wagering, racing and gambling generally — but a licensed retailer is often an alcohol-licensed premises, and access to the building is a separate question from the wagering age.

Tribal Gaming in Montana

The Montana Department of Justice records Class III compacts with several of the state's reservations, including Fort Peck, Rocky Boy's, the Crow Tribe, Fort Belknap and the Northern Cheyenne Tribe. The newest compact is the first to reach sports wagering: the Confederated Salish and Kootenai Tribes signed a new Class III compact with the state in September 2025, and the Federal Register notice of 26 January 2026 publishes its approval by operation of law. The compact text provides that "the State and Tribe have concurrent jurisdiction to regulate all sports wagering within the Reservation" and that "sports wagering may only be conducted in Tribal and Indian-owned casinos within the Reservation". Its age clause matches state law at 18. Tribal sports wagering in Montana is therefore on-reservation and in person, and does not create a remote channel.

Horse Racing Betting in Montana

This is the one Montana betting product that may lawfully be used away from a licensed building. MCA 23-4-101(1) defines advance deposit wagering as pari-mutuel wagering funded from an account held by a licensed hub operator, with the money paying for wagers "made in person, by telephone, or through a communication by other electronic means on horse or greyhound races held in or outside this state". MCA 23-4-301(7) then sets the gate:

"The board may license an advance deposit wagering hub operator to conduct advance deposit wagering. Advance deposit wagering is prohibited and illegal unless it is conducted through an advance deposit wagering hub operator licensed by the board."

The same section bars an operator from letting anyone under 18 use an account, and subsection (8) makes accepting "a Montana wager without being licensed by the state of Montana" an illegal gambling enterprise. The register is published by the Board of Horse Racing: its advance deposit wagering page names AmWest Entertainment, Day At The Track, eBet Technologies, Game Play Network, Lien Games Racing, NYRA Bets, TVG, TwinSpires and Xpressbet. The Board adds that "companies not on this list that are accepting wagers from Montana patrons are breaking Montana law", and asks that they be reported to it. Checking a racing account provider against that page is the one verification step a Montana reader can take directly.

What Is Pending in Montana

Nothing, for now, because the legislature sits in odd-numbered years. Six sports-betting measures were drafted for the 2025 session and all six died as legislative-council drafts without ever receiving a bill number, recorded in the legislature's own system as "(LC) Draft Died in Process": LC1915 "Create the sports wagering act", LC0162, LC0741 and LC2011 on revising sports betting laws, LC1875 on tax rates and LC3988 on collegiate sports gambling. Two drafts are already with the drafter for the 2027 session: LC0032, "Generally revise laws relating to sport betting", and LC0258, "Generally revise prediction market laws". Bill histories are published through the Montana Legislature's LAWS system.

Prediction Markets in Montana

Montana is recorded as a grey market, and the honest description is that the state has not addressed sports-event contracts. Searches of the Department of Justice site for both "Kalshi" and "prediction market" return "Nothing Found", and the Montana Lottery site search returns no entries for either term. No Montana cease-and-desist letter, advisory or opinion naming a prediction-market platform could be located on a state source. The only dated Montana record pointing at the subject is forward-looking: LC0258, "Generally revise prediction market laws", assigned to a drafter on 16 September 2026. A sourced absence is not proof that nothing exists, but it is the most the state's own publications support.

Responsible Gambling in Montana

The Montana Lottery's play responsibly page gives one number, 1-888-900-9979, and says that "counseling, education and information is available to you 24-hours a day, 7-days a week". It is the line run by the Montana Council on Problem Gambling, which publishes the same number as a 24-hour helpline. The Gambling Control Division of the Department of Justice describes the Council as "a non-profit agency dedicated to alleviating gambling-related social and personal distress through the provision of relevant support, referral services, and education to compulsive gamblers, their families, and other concerned Montanans".
