Our assessment

DraftKings is a US state-regulated online sportsbook operated by DraftKings Inc., offering sports betting, online casino, daily fantasy sports and horse-race wagering via DK Horse.

Who Runs DraftKings

DraftKings is one of the few sportsbook brands that is also its own listed company: DraftKings Inc. files an annual report with the United States Securities and Exchange Commission, so its accounts and its description of its own business are public. The sportsbook app in the US App Store is published by DraftKings LLC.

Why There Is No Single Licence to Check

There is no national betting licence in the United States. DraftKings' own filing describes how that came about: after the Supreme Court struck down the federal prohibition in 2018, authorisation moved state by state, and its 10-K names the states and territories that have authorised sports betting — a list that runs from Arizona and Arkansas through to Wisconsin, Wyoming and Puerto Rico. A reader checking whether DraftKings is licensed where they live is checking a state regulator, not a national register, and this site's own state-by-state record is on its United States page.

One Licence a Reader Can Check

One state licence is stated in DraftKings' own App Store listing: it says DraftKings is licensed in the State of Connecticut under licence OGO.000003, and that DraftKings Racing and DraftKings Predictions "operate separately from Sportsbook and are subject to different regulatory requirements". That is the shape of American licensing in one sentence — a licence per state, and a separate authorisation per product. Daily fantasy contests, which DraftKings started with, are regulated separately again and are outside what this site covers.

Our Take

DraftKings is a state-regulated American sportsbook operated by a listed company whose filings a reader can read. Where it is available depends entirely on the state: the brand names one licence in its own app listing, Connecticut's, and a reader elsewhere has to check their own regulator. Its racing and prediction-market products are authorised separately again, so being able to use one does not mean being able to use the others.
